1. About these terms
These terms apply to your use of ikonyx.ca and to every quote, order and sale from IKONYX Canada Inc. ("IKONYX", "we", "us"), operating as IKONYX Surfaces from our showroom at 44 Samor Rd, North York, ON M6A 1J6. By using our website or placing an order, you agree to these terms. Nothing here limits any rights you have under Ontario consumer protection law that cannot be waived.
2. Website information
Product photos, colours and patterns on screen are for reference only. Screens, lighting and printing change how a surface looks. Sizes, thicknesses, finishes and technical data come from the manufacturers and may change without notice. Products shown on our website are not a promise of stock; availability is confirmed only in a written quote or order confirmation.
3. Quotes and prices
We don't sell online. Prices are given by written quote only. Quotes are in Canadian dollars and do not include HST, delivery, fabrication or installation unless the quote says so. Quotes are valid for the period stated on them and are subject to stock availability. We may correct obvious pricing or typing errors before an order is confirmed.
4. Orders and payment
An order is confirmed only when we issue a written order confirmation or invoice and receive the deposit stated on it. The balance is due before delivery or pickup unless agreed otherwise in writing. Special orders (items we bring in for you or that are not held in our stock) may require full payment or a non-refundable deposit, as stated on your quote. Slabs remain the property of IKONYX until paid in full.
5. Natural variation and slab selection
Porcelain slabs are made to look like natural stone. Colour, shade and veining can differ between slabs, between production batches, and from photos and samples. Samples, photos and catalogue images show the general look, not the exact slab you will receive. We strongly recommend choosing your actual slabs in our showroom; slabs you select and approve are accepted as to colour, shade and pattern. Bookmatched slabs are sold as matched pairs. Minor differences in size and thickness within the manufacturer's tolerances are not a defect.
6. Measurements, fabrication and installation
You are responsible for the measurements you give us, unless a fabricator has taken templates on site. Fabrication and installation are arranged through independent partner contractors, whose work is covered by their own agreement and warranty with you. You must make sure cabinets, floors and walls can support the weight of the slabs and are level and ready on the agreed date. We are not responsible for site conditions, plumbing, electrical work, or damage to existing finishes during installation by third parties.
7. Delivery, pickup and storage
We deliver across the GTA and to other Ontario areas on request. Delivery fees and dates are confirmed in your quote. Delivery dates are estimates, and we are not responsible for delays caused by suppliers, weather, transport or other events outside our control. For delivery, you must provide safe, clear access and have an adult (18+) present to receive and sign for the goods. Delivery is to ground level unless agreed in writing. For pickup, you must bring a vehicle and equipment suitable for large slabs; responsibility for the goods passes to you once they are loaded. Orders not picked up or accepted within a reasonable time after we notify you may be subject to storage fees.
8. Inspection and damage claims
Please inspect your slabs at delivery or pickup, before signing. Note any visible damage on the delivery slip and report it to us promptly, with photos. Cutting, fabricating or installing a slab means you accept its condition, colour and pattern; we can't accept claims for visible defects after that.
9. Returns, exchanges and cancellations
Slabs are final sale once cut, fabricated, special-ordered, or bought as remnants or on promotion. Returns of uncut stock slabs in original condition are accepted only with our prior written approval and may be subject to a restocking fee and return transport costs. Cancelling a confirmed order may result in loss of your deposit or charges for costs already incurred.
10. Remnants, promotions and limited offers
Remnants are sold as is; sizes are approximate and stock is first come, first served. Promotions apply to selected items while stock lasts, can't be combined with other offers unless stated, and may end without notice.
11. Care and warranty
Clean porcelain with warm water and a mild, pH-neutral cleaner. Avoid abrasive pads and harsh chemicals, and use trivets under very hot cookware. Where a manufacturer provides a product warranty, we pass it on to you. We give no other warranty beyond what the law requires. Warranties don't cover misuse, impact damage, improper fabrication or installation, thermal shock, harsh chemicals or normal wear.
12. Limitation of liability
To the fullest extent permitted by law, our total liability for any product is limited to the price you paid for it. We are not liable for indirect or consequential losses, including removal and reinstallation costs, delays or lost use. Nothing in these terms excludes liability that cannot be excluded by law.
13. Privacy
When you contact us, request a quote or book an appointment, we collect your name, email, phone number and project details. We use them only to respond to you, prepare quotes and schedule visits and deliveries. We don't sell your personal information. See our Privacy Policy, or email orderdesk@ikonyx.ca to access or delete your information.
14. Website content
All text, photos, logos and designs on ikonyx.ca belong to IKONYX or are used with permission. You may not copy or reuse them without our written consent.
15. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Toronto, Ontario.
16. Changes to these terms
We may update these terms at any time. The version posted on our website, with its "Last updated" date, applies to new orders.
